Hoeven Issues Vetoes

BISMARCK, N.D. – Gov. John Hoeven today vetoed provisions of one bill, and a second bill in its entirety from the 60th Legislative Assembly. All other bills have been signed, or will be signed, by Thursday, May 10.

Section 12 of House Bill 1012

This bill section creates an unfair excise tax exemption for enrolled tribal members outside the boundaries of the reservation. Owing to their status as sovereign entities, Native Americans who live on one of the state's reservations are not subject to taxation, including the excise tax. However, off reservation, Native Americans, are subject to North Dakota taxes on the same and consistent basis as all other North Dakota citizens, regardless of race. Therefore, in the interest of fundamental fairness, and to ensure the fair and consistent administration of North Dakota tax laws, the Governor has vetoed Section 12 of House Bill 1012.

Senate Bill 2047

Senate Bill 2047 provides for withholding a share of a new state employee's salary for a deferred compensation plan without his or her express consent. Under provisions of this bill, the employee would have 30 days after beginning employment to "opt out" of the plan. While we support and encourage saving for retirement, a state employee's permission should be obtained before withholding salary. For these reasons, the Governor has vetoed Senate Bill 2047.
